With this awareness, as the Company, we attach great importance to the processing and storage of all kinds of personal data belonging to all individuals related to the Company, including those who benefit from our products and services, in accordance with Law No. 6698 on the Protection of Personal Data ("KVKK").

This Illumination Text has been prepared by Esular as the data controller within the scope of Article 10 of the KVKK and the Communiqué on the Procedures and Principles to be Followed in the Fulfillment of the Disclosure Obligation.

Purposes of Processing Personal Data

Your collected personal data is processed for the following purposes within the scope of the personal data processing conditions specified in Articles 5 and 6 of the KVKK:

• Provision of our products and services and execution of sales processes
• Planning and execution of customer relationship management activities
• Management of order and delivery processes
• Execution of payment transactions
• Conducting communication activities
• Measuring and increasing customer satisfaction
• Provision of technical support and service
• Fulfillment of legal obligations
• Execution of finance and accounting transactions
• Conducting marketing and analysis activities (with explicit consent)
• Execution of information security processes
• Carrying out business continuity activities

Methods of Collection and Legal Grounds for Personal Data

Your personal data is collected through the following channels:

• Our websites (esular.com, store.esular.com)
• Mobile applications
• Telephone and email communications
• Physical stores and offices
• Social media channels
• Our business partners

Legal Grounds:

Your personal data is processed based on the following legal grounds specified in Article 5 of the KVKK:

• The existence of your explicit consent
• Explicitly stipulated in laws
• Directly related to the establishment or performance of a contract
• Being necessary for the data controller to fulfill its legal obligation
• The necessity of data processing for the legitimate interests of the data controller, without prejudice to the fundamental rights and freedoms of the data subject

Transfer of Personal Data

Your collected personal data may be transferred to the following parties in line with the realization of the purposes mentioned above and in accordance with Articles 8 and 9 of the KVKK:

• Our business partners and suppliers
• Cargo and logistics companies
• Payment institutions and banks
• Service providers (server, software, etc.)
• Authorized public institutions and organizations in case of legal obligation

Your personal data may be transferred abroad with your explicit consent or if other conditions stipulated in the KVKK are met.

Personal Data Retention Period

Your personal data is stored for the periods stipulated in the relevant legislation or for the period required by the processing purpose. Upon termination of the storage period, your personal data is deleted, destroyed, or anonymized in accordance with KVKK and relevant legislation.

General storage periods:

• Commercial ledgers and documents: 10 years
• Customer transaction records: 10 years
• Agreements: Agreement period + 10 years
• Communication records: 3 years
• Cookie data: Varies by cookie type

Rights of the Data Subject

Pursuant to Article 11 of the KVKK, as a personal data owner, you have the following rights:

1. Learning whether your personal data is processed
2. Requesting information about the processing of your personal data
3. Learning the purpose of processing of your personal data and whether they are used in accordance with their purpose
4. Knowing the third parties to whom your personal data is transferred, domestically or internationally
5. Requesting the correction of your personal data if it has been processed incompletely or incorrectly
6. Requesting the deletion or destruction of your personal data within the framework of the conditions stipulated in Article 7 of the KVKK
7. Requesting notification of rectification, erasure, and destruction operations to third parties to whom your personal data has been transferred
8. Objecting to an outcome that is detrimental to you solely through the analysis of your processed data by automated systems
9. Requesting compensation for damages if you suffer loss due to unlawful processing of your personal data

To exercise your rights mentioned above, you can choose one of the following methods:

• Email: Application to kvkk@esular.com with documents identifying your identity
• Mail: Application by submitting a wet-signed petition to the address: Reşitpaşa Mah. Katar Cad. Arı 4 Binası No: 2/50/6 Sarıyer/İstanbul
• KEP: Application via registered electronic mail

Your applications will be concluded free of charge as soon as possible, and at the latest within 30 (thirty) days, depending on the nature of your request. However, if the transaction requires an additional cost, a fee may be charged according to the tariff determined by the Personal Data Protection Board.
